Terms of application

Please read these Terms and Conditions (“Terms”) carefully before using the Foodstr Service and app (“Service”) operated by Foodstr Inc. Delaware (“we”). By starting to use our Service, you agree to these Terms of use and Privacy Policy. Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms are applied to all visitors, users, and others who wish to access or use the Service.

The Foodstr is a service and mobile app that will guide you through products' ingredients and will help to find healthy ones.

By using our Service, you can:

  • scan the products and receive information about the ingredients;
  • get the rating of the product, which depends on whether they contain food additives;
  • review the information on food additives;
  • receive up-to-date articles on various topics about healthy diet;
  • create your own shopping list and share it with other users;
  • get scan rating, showing the products that were scanned most frequently within a day / month / year.

The Foodstr app. To use our Service, you should download the Foodstr app that is available on the App Store or Google Play (“Download platforms'').

Personal account. To enjoy our Service functionalities, you need to create a personal account.

You can sign up by logging into Service with an email or an existing Facebook account, Google account or Apple ID.

If you sign up by email, we will send a verification letter to your email. If you want to log into the Service from another device, we will resend you a verification letter, so you can enter and enjoy our Service.

Free usage. Pay attention, you can use our Service for free, however some listed functionalities are only available if you get a subscription.

Subscription types. We offer you monthly and annual subscription. You can check up-to-date subscription fees in our app. You may cancel the subscription at any time at least one day before each renewal day. Subscription automatically renews unless you cancel it.

Payment. You may pay for the Service after downloading using the suggested payment methods. We specify the subscription fee in USD. Your payment will be converted in USD by using the following currency converter valid on the date of payment.

Free trial. Within the trial period, you may test all functionalities of our Service for free. Pay attention, free trial term depends on the subscription type you choose. When the free trial expires, the subscription fee will be charged automatically, unless you cancel the subscription.

General terms. We value any feedback and do everything to make you happy with our Service. However, if you are not completely satisfied with your subscription type, you can get a refund according to the terms outlined below. Pay attention, we may be limited in what actions we can perform on personal accounts, depending on the payment platform you choose.

App Store. If you purchase a subscription via the App Store, Apple is solely responsible for processing payments and refunding the subscription fee. Therefore, we are not allowed to cancel your current subscription or refund you any subscription fee directly. In this case, you need to contact the App Store customer support department directly and request a refund by using the following link: https://getsupport.apple.com/.

Google Play. If you purchase your subscription through Google Play, you can send your refund request to: email. We are able to consider your refund request within 30 days from the purchase date. Please pay attention, certain refund requests may be considered by us on a case-by-case basis and granted at our sole discretion.

You must not, directly or indirectly:

  • access all or any part of the Service in order to build a product or service which competes with the Service;
  • use the Service to provide services to third parties;
  • use the Service in a manner that is illegal or causes damage or injury to any person or property;
  • use the Service in unlawful, harmful, threatening, defamatory, obscene, infringing, harassing, racially or ethnically offensive manner.

The Service and its original content, excluding content provided by users, features and functionality are and will remain the exclusive property of Foodstr Inc. and its licensors.

The Service is protected by copyright, trademark, and other laws around the world. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Our Service may contain links to other sites that are not operated by us.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services. We strongly advise you to review the privacy policy of every site you visit.

Should you violate our Terms, we may terminate or suspend your access to the Service under our sole discretion.

All provisions of the Terms which by their nature should survive termination, must survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity.

You agree to defend, indemnify and hold us, our licensee and licensors, their employees, contractors, agents, officers and directors harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • your use and access of the Service;
  • a breach of these Terms.

We do our best to meet your expectations and provide you with a high-quality Service, however we, our subsidiaries, affiliates, and its licensors could not warrant that:

  • the Service will function uninterrupted, will be secure or available at any particular time or location;
  • any errors or defects will be corrected;
  • the Service is free of viruses or other harmful components;
  • the results of using the Service will 100% meet your requirements.

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

These Terms must be governed and construed in accordance with the laws of the state of Delaware, USA, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

We may update our Terms of use from time to time. We will let you know about updates via email or a prominent notice on our Service, prior to the changes becoming effective.

Changes to these Terms of use are effective when they are posted on this page.
